These are the terms on which we provide BOB and on which you agree to use it.
They are deliberately concise: a private beta does not require forty pages to
set out what each party owes the other.
Who you are dealing with
BOB is provided by JC1 LTD, a company registered in Northern Ireland
under company number NI711308, trading as jc1.tech. Our registered
office address is held on the public register at Companies House. In these
terms, "we" and "us" mean JC1 LTD, and "you" means you.
By creating an account or using BOB, you agree to these terms. If you do not
accept them, please do not use the service; if you have already created an
account, contact us and we will close it.
The short version
This summary is provided for convenience only. It does not replace the
sections below, which are the terms that apply.
BOB is in beta, it is free, and it will sometimes break.
Your content is yours. We do not claim it and we do not sell it.
Do not use BOB for anything illegal, and do not try to break it.
Keep your own copy of anything important.
Either party may end the arrangement at any time.
This is beta software
BOB is incomplete and under active development. This is not a defensive
formality but an accurate description of the product's current state, and
you are participating at an early stage by design.
In practice, you should expect that:
features will change, move or be removed without notice;
there will be bugs, some of them serious;
the service will be unavailable from time to time, without advance notice;
data can be lost. We take backups and we test, but beta software does lose data, and we will not represent otherwise.
Accordingly, you should keep your own copy of anything you cannot afford to
lose, and should not rely on BOB as the sole record of material information.
Export is available, and we will assist you with it on request.
We would rather be told about a problem than not. Reporting issues is the
most valuable contribution a tester makes.
Your account
You must be 16 or over to use BOB.
Access to the beta is by invitation and is personal to you. Please do not share your credentials.
Keep your sign-in details secure. You are responsible for activity under your account, except where it results from our failure.
Provide a working email address. We use it to send sign-in links and to notify you of any problem affecting your account.
Tell us promptly if you think someone else has got into your account.
Using BOB properly
You agree not to:
use it unlawfully, or to cause harm to any person;
upload other people's personal data without a proper basis for doing so;
try to access another user's account or data;
probe, scan or attack the service, or work around its security or rate limits;
scrape it, resell it, or run it as a service for other people;
reverse-engineer it, except where the law says you may;
upload malware, or deliberately overload the infrastructure.
Security research is welcome where you notify us first and allow a reasonable
period to remedy what you find. Please email
security@jc1.tech. We will not pursue
any claim against a researcher acting in good faith under this section.
Your content stays yours
You keep every right you have in what you put into BOB - your goals, notes,
journals, plans and data. We claim no ownership of it.
You give us only the permission we need to actually run the service for you:
to store your content, back it up, display it to you, and process it to
deliver the features you have turned on. That permission exists to operate
BOB and for nothing else. It ends when you delete the content or your
account.
We do not sell your content, we do not use it to train AI models, and we do
not use it for advertising. What we do with it is described in the
privacy policy, which forms part of these terms.
If you send us feedback or a feature suggestion, we may act on it freely and
without obligation to you. This is not a claim over your ideas; it reflects
the practical need to develop the product without exposure to a claim each
time an evident improvement is implemented.
AI output
BOB's AI features are optional and disabled until you enable them. Where you
use them, treat the output as a suggestion produced by a system that is
sometimes confidently incorrect.
AI output may be inaccurate, incomplete or meaningless. Verify it before relying on it.
It does not constitute medical, financial, legal or other professional advice, however it may be phrased. The coaching, fitness and finance features provide general information, not advice addressed to your circumstances.
Consult a qualified professional before making decisions about your health or your finances. A planning tool is not a substitute for a clinician or an accountant.
Similar output may be produced for other users. Nothing in AI output is exclusive to you.
Connected services
You can connect BOB to services like Google Calendar, Strava or your bank.
Every one of those is optional, and off until you connect it.
Those services are run by other companies under their own terms and their
own privacy policies. We are not responsible for what they do, whether they
are available, or what happens if they change their API and something in BOB
stops working. You can disconnect from within BOB, and revoke our access
from their side, at any time.
Price
The beta is free. There is nothing to pay and no card on file.
BOB is intended to become a paid product. If we introduce charges, we will
give you reasonable advance notice, and we will not begin charging an existing
account without first obtaining your express agreement. Nothing in these terms
permits us to bill you without your consent.
What we promise, and what we do not
We will make reasonable efforts to keep BOB available, to remedy faults, and
to safeguard your data appropriately.
But we do not offer a service level, an uptime guarantee, or a support
response time, and beyond what the law requires, BOB is provided "as is" and
"as available" without warranties of any kind. We may change, suspend or
withdraw any part of it, and we may end the beta.
If you are a consumer, you have rights under the Consumer Rights Act 2015
and other consumer protection law. Nothing here takes those away or limits
them, and where these terms conflict with your statutory rights, your rights
win.
Liability
First, the part that is not up for negotiation. Nothing in these terms
limits or excludes our liability for death or personal injury caused by our
negligence, for fraud or fraudulent misrepresentation, or for anything else
that cannot lawfully be limited.
Subject to that, and because BOB is free and in beta:
We are not liable for lost profits, lost business, lost opportunity, or losses that were not reasonably foreseeable when you started using BOB.
We are not liable for lost or corrupted data beyond our duty to take reasonable care, which is why we ask you to retain your own copy.
Where we are liable, our total liability to you is capped at £100, or the amount you have paid us in the last 12 months if that is higher. During the beta, you will not have paid us anything.
If you use BOB for business rather than personal purposes, you accept that it
is provided without any guarantee of fitness for that use, and you assume
responsibility for the consequences of relying on it in your business.
Ending it
You may stop using BOB at any time. Delete your account within the app, or
email us and we will do so on your behalf. We will not require you to
complete a retention process first.
We may suspend or close your account if you materially break these terms, if
we are required to by law, or if we end the beta. Except where you have
seriously misused the service or the law prevents us, we will give you
reasonable notice and a chance to export your data first.
When your account ends, we delete your content as described in the
privacy policy. Please export anything you wish to
retain beforehand.
Law, and the small print
These terms are governed by the law of Northern Ireland, and the courts of Northern Ireland have jurisdiction. If you are a consumer elsewhere in the UK, you may also bring proceedings in your own home courts.
If a court finds any part of these terms unenforceable, the rest continues to apply.
If we do not enforce something straight away, we have not given up the right to enforce it later.
Nobody other than you and us has rights under these terms.
We may update these terms. For material changes we will email you before they take effect, and continuing to use BOB afterwards means you accept them. If you do not, you can close your account.
These terms and the privacy policy are the whole agreement between us about BOB.
We handle correspondence by email. Where a postal address is required for the
service of formal documents, our registered office is recorded at Companies
House against company number NI711308.
